Terms & Conditions GoClove

Last updated: 30 September 2026

These Terms & Conditions apply to all offers, orders and agreements concluded through the GoClove webshop.

1. Identity of the seller

The seller is:

ABK B.V., trading under the name GoClove
Poeldijkstraat 387
1059 VL Amsterdam
The Netherlands

Chamber of Commerce number: 97617091
VAT number: NL868137613B01
Email: support@goclove.eu

Hereinafter referred to as “GoClove”, “we”, “us” or “our”.

2. Applicability

These Terms & Conditions apply to every offer made by GoClove and to every agreement between GoClove and a customer through our webshop.

“Customer” means any natural person or legal entity that orders a product from us.

Consumers remain entitled to any mandatory consumer protection rights that apply in the country where they habitually reside, insofar as such rights cannot legally be excluded.

Where different provisions apply to business customers, this will be expressly stated.

3. Offers and product information

We make reasonable efforts to display products, prices, sizes, colours, materials, images and other product information as accurately as possible.

Minor deviations that do not affect the normal use of the product do not automatically entitle the customer to terminate the agreement.

Obvious errors, typographical mistakes or pricing errors are not binding on us where it should reasonably have been clear to the customer that an error had occurred.

4. Formation of the agreement

An agreement is concluded after the customer has completed the ordering process and the order has been confirmed by us, unless we are unable to accept the order on reasonable grounds.

Before placing the order, the customer is given the opportunity to review the order and correct any input errors.

After the order has been placed, the customer will receive an electronic confirmation.

Before a consumer places an online order, clear information must be available regarding, among other things, the main characteristics of the product, the total price, payment terms, delivery and the right of withdrawal.

5. Prices

Consumer prices shown on the website include applicable VAT unless expressly stated otherwise.

Any shipping costs and other additional charges will be clearly displayed before the order is completed.

For business customers, prices may be displayed excluding VAT where this is clearly indicated.

6. Payment

The available payment methods are shown during the ordering process.

Payments may be processed through Shopify Payments and other available payment service providers.

The customer is responsible for providing correct payment information.

We may suspend or cancel an order if payment is not received or where there are reasonable grounds to suspect fraud or misuse.

7. Delivery

We deliver orders to the delivery address provided by the customer.

Available delivery methods and any shipping charges are shown during the ordering process.

Where no specific delivery date has been agreed, we aim to deliver the order as soon as reasonably possible. Consumers also retain any statutory rights regarding delivery.

Where no delivery period has been agreed, delivery will in principle take place within the period required by applicable law.

A delay does not automatically give rise to a right to compensation unless mandatory applicable law provides otherwise.

8. Risk during shipment

For consumers, the risk of loss of or damage to the product generally remains with GoClove until the consumer, or a third party designated by the consumer other than the carrier, has physically received the product.

An exception may apply where the consumer independently chooses a carrier not offered by GoClove.

For business customers, risk may pass when the goods are handed over to the carrier, unless otherwise agreed in writing.

9. Right of withdrawal for consumers

Consumers purchasing a product at a distance generally have the right to withdraw from the agreement within 14 days without giving a reason, subject to statutory exceptions.

The withdrawal period generally begins on the day after the consumer, or a third party designated by the consumer other than the carrier, receives the product.

The consumer may exercise the right of withdrawal by informing us clearly, before the end of the withdrawal period, of the decision to withdraw from the agreement.

The consumer may use the available model withdrawal form, but is not obliged to do so.

10. Returns following withdrawal

After exercising the right of withdrawal, the consumer must return the goods within the legally applicable period.

The consumer may inspect and handle the product in a way comparable to what would reasonably be permitted in a physical store.

If the product has been used beyond what is necessary to establish its nature, characteristics and functioning, the consumer may be liable for any resulting reduction in value, insofar as permitted by law.

The absence of the original packaging does not in itself cause the statutory right of withdrawal to lapse.

Return shipping costs are borne by the party identified as responsible for those costs in the information provided before purchase.

11. Refund following withdrawal

Where a consumer validly withdraws from the agreement, we will refund payments received in accordance with the applicable statutory rules.

Where permitted by law, we may withhold the refund until we have received the product or until the consumer provides evidence that the product has been returned.

Refunds will generally be made using the same payment method used for the original transaction, unless otherwise agreed.

12. Exceptions to the right of withdrawal

The right of withdrawal may be excluded by law for certain products or services.

An exception only applies where it is legally applicable and the consumer was correctly informed of it before purchase.

13. Statutory conformity and defects

We are responsible for ensuring that delivered products comply with applicable statutory conformity requirements.

Consumers retain all statutory rights in relation to defective or non-conforming goods.

These statutory rights are not limited by any voluntary commercial warranty.

14. Voluntary warranty

Where GoClove, the manufacturer or another party provides an additional commercial warranty, that warranty is supplementary to the consumer’s statutory rights.

The terms of such warranty will be stated separately.

A voluntary warranty does not restrict the consumer’s statutory rights.

15. Complaints

Complaints regarding an order or product may be sent to:

support@goclove.eu

We ask customers to report complaints as soon as reasonably possible after discovering the issue so that we can investigate properly.

A consumer does not lose a statutory right solely because a complaint was not submitted within a short period set by us, where mandatory consumer law provides otherwise.

16. Liability

We are liable for damage to the extent that such liability arises under applicable law.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is not permitted by law.

In particular, we do not exclude liability for damage resulting from wilful misconduct or gross negligence, or for death or personal injury where such exclusion is prohibited by law.

For business customers, liability may be further limited to the extent permitted by applicable law and where agreed in writing.

17. Force majeure

We are not liable for failures caused by circumstances beyond our reasonable control, insofar as and for as long as those circumstances prevent us from fulfilling our obligations.

Such circumstances may include:

  • natural disasters;
  • war or serious civil unrest;
  • prolonged failures of logistics or technical infrastructure;
  • government measures;
  • other unforeseen circumstances beyond our reasonable control.

Mandatory consumer rights remain unaffected.

18. Retention of title

To the extent permitted by applicable law, delivered products remain the property of GoClove until the full purchase price has been paid.

19. Intellectual property

All intellectual property rights relating to the website, texts, images, trade names, trademarks, designs and other content remain with GoClove or the relevant rights holder.

Without prior permission, such content may not be used in a manner that infringes those rights.

20. Personal data

We process personal data in accordance with our Privacy Policy.

The current Privacy Policy is available on our website.

21. Applicable law

Agreements with GoClove are governed by Dutch law.

For consumers, however, this choice of law does not deprive them of the protection of mandatory provisions of the law of the country in which they habitually reside, where that law would otherwise apply under applicable conflict-of-law rules.

22. Disputes and competent courts

Disputes should preferably first be resolved through consultation between the parties.

For consumers, the competent court and procedural rights are determined by applicable mandatory consumer and procedural law.

For business customers, the parties may, to the extent permitted by law, agree that disputes will be submitted to the competent court in the Netherlands.

23. Language

These Terms & Conditions may be made available in several languages.

Where different language versions exist, we aim to keep them substantively equivalent.

For consumers, the version appropriate to the language and market in which the agreement is concluded will be used.

24. Amendments

We may amend these Terms & Conditions for future agreements.

The version in force at the time the agreement was concluded will generally continue to apply to that agreement.

25. Severability

If any provision of these Terms & Conditions is found to be wholly or partly invalid or unenforceable, the remaining provisions remain in force.

The invalid provision will, where possible, be replaced by the applicable statutory rule.
